กฎหมาย หมายถึง ข้อบังคับที่รัฐหรือประเทศได้กำหนดขึ้น เพื่อใช้บังคับความประพฤติของบุคคลในเรื่องความสัมพันธ์ระหว่างกัน ถ้าใครฝ่าฝืนไม่ปฏิบัติตามก็จะมีความผิดและถูกลงโทษ
ถ้าประชาชนทุกคนปฏิบัติตามกฎหมายแล้ว ย่อมเกิดประโยชน์แก่ตนเอง คือ ไม่ต้องถูกลงโทษเพราะกระทำความผิด และเกิดประโยชน์ต่อส่วนรวม คือ สร้างความเป็นระเบียบเรียบร้อยและสร้างความสงบในสังคมด้วย
การปฏิบัติตามกฎหมายในชีวิตประจำวัน เช่น เมื่อมีคนเกิด เจ้าบ้านหรือบิดามารดาต้องไปแจ้งเกิดเพื่อขอรับสูติบัตร เมื่อครบ ๑๕ ปี ต้องไปทำบัตรประจำตัวประชาชน และเมื่อจะเดินทางไปไหนมาไหน ก็ต้องปฏิบัติตามกฎหมายจราจร เป็นต้น
กฎหมายที่เกี่ยวข้องกับครอบครัว
ครอบครัวเป็นสถาบันหลักของสังคมไทย ในแต่ละครอบครัวจะมีสมาชิกซึ่งอยู่ในสถานภาพต่างกัน เช่น บิดา มารดา บุตร สามี ภรรยา ดังนั้นสมาชิกทุกคนจะต้องรู้หน้าที่ของตนว่าจะต้องปฏิบัติอย่างไรจึงจะถูกต้องตามกฎหมาย และอยู่ร่วมกันได้อย่างมีความสุข
กฎหมายที่เกี่ยวข้องกับครอบครัว ที่ควรศึกษาได้แก่
๑. สิทธิ หน้าที่ของบิดา มารดา และบุตร
๒. การรับรองบุตร บุตรที่เกิดมา โดยที่บิดามารดาไม่ได้จดทะเบียนสมรสกันถือว่าบุตรคนนั้นเป้นบุตรทีชอบด้วยกฎหมายของหญิง แต่เป็นบุตรนอกกฎหมายของชาย กฎหมายจึงเปิดโอกาสให้ชายจดทะเบียนรับรองบุตรได้ เพื่อให้เป็นบุตรที่ชอบด้วยกฎหมาย
๓. กฎหมายเกี่ยวกับความสามารถของผู้เยาว์
ผู้เยาว์ คือ เด็กหรือบุคคลซึ่งยังไม่บรรลุนิติภาวะ บุคคลจะพ้นจากการเป็นผู้เยาว์จะต้องมีอายุครบ ๒๐ ปี บริบูรณ์ หรือเมื่อทำการสมรสถูกต้องตามกฎหมาย
กฎหมายถือว่า ผู้เยาว์เป็นผู้ที่ไม่พร้อมจะใช้สิทธิและปฏิบัติหน้าที่ได้โดยลำพัง เพราะผู้เยาว์ยังอ่อนทั้งในด้านความคิด ความรู้ ความชำนาญ และไหวพริบ อาจจะถูกผู้อื่นเอาเปรียบได้ ดังนั้นกฎหมายจงจำกัดความสามารถของผู้เยาว์ โดยยึดหลักว่าผู้เยาว์จะใช้สิทธิเพื่อทำการใด ๆ ที่จะก่อให้เกิดผลผูกพันทางกฎหมายโดยลำพังไม่ได้จะต้องให้ผู้แทนโดยชอบธรรมกระทำแทน หรือต้องได้รับความยินยอมจากผู้แทนโดยชอบธรรมก่อน
ผู้แทนโดยชอบธรรมของผู้เยาว์
๑. ผู้ใช้อกนาจปกครอง หมายถึง บิดา มารดา
๒. ผู้ปกครอง หมายถึง บุคคลอื่นนอกจากบิดา มารดา ซึ่งถูกแต่งตั้งขึ้นเพื่อปกครองผู้เยาว์
*ควรรู้-ควรจำ* นิติกรรมที่ผู้เยาว์สามารถกระทำได้ด้วยตนเอง มีดังนี้
๑. หากเป็นเพียงเพื่อจะได้สิทธิอันใดอันหนึ่ง หรือเป็นการให้หลุดพ้นจากหน้าที่อันใดอันหนึ่ง ได้แก่ กิจการอันเป็น ประโยชน์แก่ผู้เยาว์ฝ่ายเดียว เช่น ผู้เยาว์รับทรัพทย์สินที่บุคคลอื่นให้โดยเสน่หา โดยไม่มีข้อผูกมัดหรือเงื่อนไขใด ๆ ทั้งสิ้น
๒. กิจการที่จะต้องทำเองเฉพาะตัว เช่น การเข้าสู่พิธีสมรส การรับเด็กเป็นบุตร
๓. กิจการที่เป็นการสมควรแก่ฐานะ และจำเป็นเพื่อการเลี้ยงดูชีพตามสมควร เช่น การซื้อของกินของใช้เล็ก ๆ น้อย ๆ
๔. ผู้เยาว์อาจทำพินัยกรรมได้เมื่ออายุครบ ๑๕ ปีบริบูรณ์ ส่วนพินัยกรรมม ซึ่งบุคคลที่มีอายุไม่คร ๑๕ ปีบริบูรณ์ ทำขึ้นนั้นถือเป็นโมฆะ
